General Terms of Use

Welcome to Shaky English ("the Application"), an application dedicated to learning English spelling and grammar rules. The Application is owned and operated by Lorelingo, a French simplified joint-stock company (SAS), registered under number 985 186 907 R.C.S. Paris, with its registered office at 78 Avenue des Champs-Élysées, Office 326, 75008 Paris.

I. Acceptance of General Terms

By downloading or using the Application, you ("the User") agree to be bound by these General Terms of Use ("Terms"). If you do not accept these terms, please do not use the Application.

You also confirm that you are at least 18 years old or using the Application under the supervision of a parent or legal guardian.

II. Description of Service

The Application offers features to help Users improve their mastery of the English language, including lessons, exercises, educational videos, and other educational resources.

III. Registration

Some features of the Application require creating an account. When registering, you agree to:

• Provide accurate, complete, and up-to-date information.
• Maintain the confidentiality of your login credentials.
• Immediately notify Lorelingo of any unauthorized use of your account.

You are responsible for all activities carried out under your account.

IV. Paid Services

1. In-App Purchases

The Application offers free content and premium content accessible through in-app purchases ("Paid Services"). In-app purchases are processed through the Apple App Store or Google Play Store, depending on your device.

2. Prices and Offers

Details of offers, prices, and associated features are available on the corresponding pages of the Application. Lorelingo reserves the right to modify prices and offers at any time. Changes will not affect purchases already made.

3. Automatic Renewal

Some Paid Services are offered as subscriptions with automatic renewal. Unless you cancel your subscription before the end of the current period, it will be automatically renewed for an equivalent duration.

4. Trial Period and Refund

Free trial periods and refund policies are those provided by the Apple App Store or Google Play Store at the time of your purchase.

V. Use of the Application

You agree to use the Application in accordance with the law and these Terms. You are prohibited from:

• Using the Application for illegal, fraudulent, or unauthorized purposes.
• Copying, modifying, distributing, or transmitting any content from the Application without prior written authorization from Lorelingo.
• Transmitting viruses, Trojan horses, or any other malicious code.
• Attempting to gain unauthorized access to Lorelingo's systems or those of its partners.
• Infringing on the intellectual property rights of Lorelingo or third parties.

VI. User Content

You may submit content (comments, messages, etc.) in the Application. By submitting content, you represent and warrant that:

• You hold all necessary rights to this content.
• The content does not violate any law or the rights of any third party.
• You grant Lorelingo a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display this content in connection with the operation of the Application.

VII. Intellectual Property

All intellectual property rights relating to the Application and its content (excluding user content) are the exclusive property of Lorelingo or its licensors. Any unauthorized reproduction, representation, modification, or exploitation of this content is strictly prohibited.

VIII. Limitation of Liability

The Application is provided "as is" without warranty of any kind. Lorelingo does not guarantee that the Application will be free of errors, viruses, or interruptions.

To the extent permitted by law, Lorelingo shall not be liable for any direct or indirect damages resulting from the use or inability to use the Application.

IX. Changes to General Terms

Lorelingo reserves the right to modify these Terms at any time. Changes will be effective upon publication on the Application. It is your responsibility to regularly review the Terms. Your continued use of the Application after modification constitutes acceptance of the new terms.

X. Termination

Lorelingo reserves the right to suspend or terminate your access to the Application without notice in case of violation of these Terms or for any other legitimate reason.

XI. Refund Policy

For any refund request, please contact us. We will inform you of the steps to follow. However, please note that refunds are subject to the terms of sale indicated at the time of purchase on the App Store or Google Play Store.

XIII. General Provisions

1. Entire Agreement

These Terms constitute the entire agreement between you and Lorelingo regarding the use of the Application.

3. Applicable Law

These Terms are governed by French law. Any dispute shall be subject to the exclusive jurisdiction of the competent French courts.
